NIL marketplaces are flooded with athletes now. What separates the ones getting approached from the ones waiting? A clear, consistent personal brand.
This does not mean you need a professional media team or a marketing budget. It means:
- Your social profiles tell a coherent story (who you are, what you play, what you stand for)
- Your content gives brands something to picture — what would it look like to have their product alongside yours?

Every brand you partner with becomes part of your athlete identity. This matters more than most athletes realize early in their NIL journey.
Ask yourself: Would I be comfortable if this partnership was featured in a recruiting profile? Would a professional team’s front office raise an eyebrow?
Brands in alcohol, gambling, and certain supplement categories carry real risk for athletes with future professional aspirations — particularly under FIFA and international federation regulations that may apply at the professional level. Before signing any deal, understand what you’re agreeing to be associated with.
Negotiate Terms That Protect Your Future
Most NIL contracts presented to college athletes skew heavily in the brand’s favor. The most common problems we see:
- Overly broad exclusivity clauses — Locking you out of competing brands in an entire product category for months or years
- Unlimited usage rights — Giving the brand permission to use your image and likeness in perpetuity, for any purpose, without additional compensation
- Vague deliverables — No clear definition of what constitutes satisfactory delivery, creating liability if the brand disputes performance
- No termination clause — Binding you to the deal even if the brand behaves in a way that damages your reputation

NIL income is taxable. This surprises many athletes who receive their first deal in the form of product or a modest check. The IRS treats NIL income as self-employment income, which means you may owe quarterly estimated taxes and should be tracking every dollar earned and every legitimate expense.
Keep a simple spreadsheet logging every deal: the brand, the date, the compensation (cash or fair market value of product), and the deliverables. Consult a CPA at the start of your NIL journey — not after you’ve accumulated a year’s worth of untracked income.
